Official Rules

Langdon Tactical Technology, Inc. may host multiple giveaways (“Giveaways”). Each Giveaway is separate. Entry into one giveaway is not entry for any other giveaway. Details on the exact dates for any Giveaway, along with the prize(s) available in that Giveaway, and any other details will be listed on the Giveaways entry page (the “Giveaway Page”). These Official Rules apply to each separate Giveaway along with any other additional rules on the Giveaway Page; unless the Giveaway Page for a particular Giveaway refers to a separate set of Official Rules in which case those Official Rules will apply. 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. 

BY PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT. WITHOUT LIMITATION, THIS CONTRACT INCULDES INDEMNITIES TO THE SPONSOR(S) AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. THESE RULES, DETAILED BELOW, CONTAIN BINDING ARBITRATION FOR ANY DISPUTE THAT MAY ARISE FROM THIS CONTEST. 

Eligibility

Giveaways are open to all legal residents of the United States or District of Columbia, who are eighteen (18) years old and older at the time of entry. Those individuals who choose to enter Giveaways (“Participants”) must accept and agree to all terms and conditions of these Official Rules and any additional rules of the Giveaway Page. The Participant must meet all legal requirements including but not limited to age and firearm status.  

How to Enter

To enter Participants will be required to complete all required fields on the entrance form which may include but is not limited to: first name, last name, email address, and phone number and follow any and all instruction on the Giveaway Page. Winners of the Giveway will be required to meet all requirements of the prize fulfillment process. 

The following persons are not eligible to participate in Giveaways: employees, directors, owners of the sponsor and their families; all members and employees of third-party companies who assisted with the creation, implementation, administration or marketing of the Giveaway and their family members.  

Each Participant shall only enter the Giveaway on his own behalf and cannot enter on the behalf of another individual. Participants who: commit fraud; cheat; use unsportsmanlike or disruptive conduct; use technology or bots; or use fictitious accounts to gain unfair advantage; or in any other way fail to comply with the Giveaway process will forego all chances of winning and will be disqualified from Giveaways. All determination of acceptable entries or other disputes of the Giveaway are at the full discretion of the Sponsor and all decisions made by the Sponsor will be absolute, final and binding. 

Sponsor

Giveaways are sponsored by Langdon Tactical Technology, Inc., located at 8035 E Pecos Rd, Suite 110, Mesa, AZ 85212. Additional sponsors may be included in certain Giveaways and will be stated on the Giveaway Page. 

Online Entry

An online entry is required to enter the Giveaway. Follow the link provided on the Giveaway Page and enter all required information. Sponsor will not verify receipt of entries for Participant. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, incorrect or damaged entries. Information obtained through the Giveaway process will be subject to the Sponsor’s Privacy Policy. No purchase is required for entry of Giveaway. 

Bonus Entries

A Giveaway may provide for additional entries (“Bonus Entries”). A Participant may only receive a Bonus Entry if the minimum mandatory entry has been completed. Bonus Entries are optional and may not be available on every Giveaway. Participants must complete the required action to earn Bonus Entries. 

Referral Entries

Selected Giveaways may have an additional opportunity listed on the Giveaway Page to earn bonus entries in that Giveaway via a “referral” program whereby Participant can post a unique link in their social media feeds (all of which are free) and receive additional entries into the Giveaway for each eligible person who follows the referring link and enters the applicable Giveaway. It is Participant’s responsibility to ensure that posting of any referral link is compliant with all state and federal laws as well as the terms of service for the platform on which Participant is posting. The Participant will be subject to all Official Rules and any additional rules of the Giveaway Page. 

News Letter Subscription

By entering this Giveaway, Participant agrees to subscribe to the Sponsor’s email newsletter(s) as indicated on the Giveaway Page. Participant must continue to be subscribed to specified newsletters throughout the Promotion Period to be eligible to win a prize. If a Participant has unsubscribed during the Promotion Period the Participant will be ineligible to win. 

Promotional Period

All Giveaways will begin and end on the dates specified on the Giveaway Page. All entries must be submitted on or before 11:59 PM Arizona time on the final day of the Giveaway.

Giveaway Selection and Details

The prize(s) and value(s) will range and will be listed on the Giveaway Page. The odds of winning a Giveaway depend on the number of eligible entries received for that Giveaway.  

Winner Selection

Giveaways will be determined by a random drawing of eligible entries selected by a representative of the Sponsor. Winners will be notified by phone or email after the conclusion of the Giveaway. If the potential winner cannot be contacted within 5 days, is determined to be ineligible, or for any other reason is unable to collect the prize the Sponsor may select an alternate winner through the Winner Selection process. No liability is assumed for any winner notification.  

Firearm Eligibility

When a firearm is a prize, the potential winner will be required to verify their firearm eligibility. Winners are subject to all federal, state and local firearms laws and regulations to receive a firearm. This may include a background check and satisfying other requirements as may be required by law. The winner is responsible for compliance with all federal, state and local firearms laws and regulations. Firearms will be shipped to the potential winners FFL dealer of choice in the winner’s state of residence. If the winner is unwilling or unable to accept the transfer from their FFL the firearm will revert to the Sponsor who may select an alternate prize winner. 

Prizes

Sponsor makes no warranty, representation or guarantee for any Prize. All warranties are maintained by their manufacturer. Prizes are awarded in “As Is” condition. 

Prize Information

Sponsor will provide detailed information to the winner on how the prize will be received in the Prize Email. Sponsor will provide standard trackable delivery in prizes where it is necessary. The winner shall be solely responsible for all federal, state, and/or local taxes and other fees associated with prize receipt and/or use. The prize may not be assigned or changed except at the sole and absolute discretion of Sponsor. Prizes pictured in advertising, marketing, or promotional materials are for illustrative purposes only. In the event there is a discrepancy or inconsistency between statements contained in any such materials and the terms and conditions of these Official Rules, these Official Rules together with the additional rules on the Sweepstakes Page for the specific prize shall prevail, govern and control. 

Prize Documents

Winners will be required to fill out the appropriate paperwork for their prize. If the value of a prize is equal to or more than $600.00 then winner will complete a W-9 and Sponsor shall issue to the winner a 1099. Winner may also be responsible for completing a Release of Liability, a Publicity Release and any and all other documents as stated in the Prize Email. All requested prize documents must be completed and returned before prize will be provided to winner. Failure to provide the required information shall be a forfeiture of the prize.  

Transfer of Firearms

Transfer of any prize falling under the legal definition of a firearm, shall be conducted through a federally-licensed Federal Firearms License (FFL) dealer. All firearms transfers will be conducted in strict compliance with all applicable federal, state and local laws. If, at any time prior to fulfillment of the prize, the potential winner is unable, unwilling, or barred from obtaining or using a firearm, the potential winner will be declared ineligible. By entering this Giveaway, Participant warrants that Participant is not legally prohibited from owning or taking possession of a firearm.  

Publicity

Giveaway winners consent to the use of winner’s name, likeness, photograph, voice, statements, opinions, city and state for Sponsor’s promotional purposes across all media platforms. 

Release From Liability

Participant agrees to release and hold harmless Sponsor and any third-party provider from and against any cause of action, including but not limited to injury, death, property loss or damage arising out of the Giveaway, or the receipt or misuse of the Giveaway prize(s). 

General Conditions/Force Majeure

Sponsor reserves the right, without prior notice and at any time, to terminate, modify, suspend or extend Giveaways. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor, the Sponsor in its sole discretion may modify, suspend or terminate the Giveaway. Sponsor is not responsible for any and all conditions beyond their control man-made or otherwise that may negatively impact the administration of the Giveaway these items may include but are not limited to: flood, fire, riot, civil disturbance, court order or health epidemic. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. 

Governing Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Arizona, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Arizona. Except where prohibited, each participant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action. 

Arbitration

Any claim, controversy, or dispute (whether in contract, tort, or otherwise) arising directly or indirectly out of or related to the Giveaway shall be resolved exclusively by a final and binding arbitration administered by the American Arbitration Association (the “AAA”) and conducted before a sole arbitrator pursuant to the applicable Rules and Procedures established by the AAA. This arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (the “FAA”), 9 U.S.C. §§ 1-16. The arbitration shall be conducted in the English language. The arbitration shall be held at a location determined by the AAA pursuant to the Rules and Procedures (provided such location is reasonably convenient for Participant), or at such a location as may be mutually agreed by the Participant and Sponsor. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules, together with any other additional rules on the Giveaway Page, and any of the other agreements referenced herein that the Participant may have entered into in connection with the Giveaway. The arbitrator shall apply the laws of the State of Arizona consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law. To the extent permitted by law, Participant agrees that under no circumstances will the Participant be permitted to obtain an award for, and Participant hereby waives all rights to, consequential, incidental, punitive damages, or any other damages, and any and all rights to have damages multiplied or otherwise increased. 

This agreement to arbitrate claims and disputes is intended to be broad and includes, without limitation, (i) claims or disputes relating to any aspect of the Sweepstakes, whether based in contract, tort, statute, or any other legal theory, (ii) claims or disputes directly or indirectly arising from conduct or events that occurred prior to the effective date of these Rules (including, without limitation, claims relating to advertising), or after its termination, (iii) claims or disputes subject to class action litigation in which Participant is not currently a member of a certified class, and (iv) claims or disputes with any agent, employee, successor or assign of Participant, the Sponsor, the Administrator, or any Released Party (all such claims and disputes are referred to collectively as “Claims”). This agreement to arbitrate does not, however, include Claims pertaining to intellectual property rights. 

No award or finding or stipulation of fact by the arbitrator will have any preclusive or collateral estoppel effect in any other arbitration or court, unless it involves the exact same parties. 

If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable or illegal provision were not contained herein. 

Severability

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings are used in these Official Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of Sponsor.
